Terms of Use

These Terms of Use ("Terms") govern your use of the GoWindow application ("the App") developed by VCodeworks LLC ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Description of Service

GoWindow is a boating and fishing weather application that evaluates marine and atmospheric conditions against user-configured thresholds to provide a Go/Caution/No-Go status indicator. The App is available on iPhone and Android.

2. Subscription and Payment

GoWindow is available as an auto-renewing annual subscription at $9.99 per year.
A 7-day free trial is available for new subscribers.
Payment will be charged to your Apple ID account (iPhone) or Google Play account (Android) at the confirmation of purchase.
Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your current subscription.
You can manage and cancel your subscription in your Apple ID account settings (iPhone) or Google Play Store subscription settings (Android).
Any unused portion of a free trial period will be forfeited when you purchase a subscription.

3. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, regarding:

The accuracy, reliability, or completeness of weather or marine forecast data
The suitability of conditions for boating, fishing, or any water-based activity
The continuous, uninterrupted, or error-free operation of the App

GoWindow is not a substitute for official NOAA marine forecasts, local weather advisories, or professional weather advice. Always consult authoritative sources and use your own judgment before going on the water.

4. Limitation of Liability

To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

Your use or inability to use the App
Any decisions made based on information provided by the App
Any errors or inaccuracies in weather or marine data
Unauthorized access to or alteration of your data

5. User Responsibilities

You are solely responsible for any decisions made based on information provided by the App.
You agree to use the App in compliance with all applicable laws and regulations.
You understand that the Go/Caution/No-Go status is determined by the thresholds you configure and does not constitute professional advice.

6. Weather Data Sources

The App uses data from Open-Meteo and Apple WeatherKit (iPhone). We do not guarantee the accuracy of data from these third-party providers. Weather forecasts are inherently uncertain and should be treated as estimates, not guarantees.

7. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, and software, are the exclusive property of VCodeworks LLC and are protected by copyright, trademark, and other intellectual property laws.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Platform End User License Agreements

Apple (iPhone): Use of GoWindow on iPhone is also subject to Apple's Licensed Application End User License Agreement, available at apple.com/legal/internet-services/itunes/dev/stdeula. In the event of a conflict between these Terms and Apple's EULA, Apple's EULA shall prevail.

Google (Android): Use of GoWindow on Android is also subject to the Google Play Terms of Service, available at play.google.com/about/play-terms.

10. Termination

We reserve the right to terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

11. Changes to These Terms

We may revise these Terms from time to time. The most current version will always be posted on this page with an updated effective date. Your continued use of the App after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.
